No smooth Registration

Sir,
As we all are aware about divesting of powers of judiciary under The Registration Act soon after reorganisation of Jammu & Kashmir State whereby newly created sub-registrars in each and every district of Union territory of J & K as well as U.T of Ladakh were vested with the powers of registration of documents. The lawyer’s fraternity across Jammu province and also in Ladakh were up in arms against the change in prevailing system of registration of documents, however for one reason or the other could not succeed and ultimately had to succumb to the pressure from and adamancy of the administration in UT. Undoubtedly, lawyers’ fraternity and many people from the civil society as well as common masses were keeping genuine apprehensions and concerns about the registration of documents in a newly created system, yet there was no sincere or honest resolution from the administration for welfare of the public. Be that as it may, now when the newly appointed Sub-Registrars have assumed the powers of registration and started registration of documents since long, the genuine apprehensions and concerns which the lawyer’s fraternity had raised during its agitation, are proving correct as it is widely accepted day in and day out that powers of registration were inherently safe and transparent with the judiciary. Nowadays, registration of documents in the newly created offices of Sub-Registrars at different places has become so difficult and cumbersome for a common man as one is scared of the inefficiency, inordinate delay and unwarranted procedures and queries while getting the document registered. It normally takes more than a month for getting the document registered as long dates are given in a lackadaisical manner, whenever a document is presented for registration. It is widely experienced that newly appointed Sub-Registrars mostly untrained are not fully acquainted with the rules and laws governing the registration of documents. In totality, it is not a smooth sailing for a common man if he intends to get the document registered after purchasing the land or property or otherwise. The administration despite knowing about many loopholes in the newly created registration system likes to remain in deep slumber thereby further adding to miseries of common masses.
