KOCHI, Nov 14:
The Kerala High Court today issued order to continue the trial proceedings under Section III of the Prevention of Insults to the National Honour Act 1971 against Union Minister of State for Human Resource Development Shashi Tharoor in a case related to disrespect to the National Anthem.
The order was issued by Single Bench Judge S S Satheeshchandran, while dismissing the plea by Mr Tharoor challenging the Ernakulam Additonal Chief Judicial Magistrate order to proceed trial against him in the case under Section III of the Prevention of Insults to the National Honour Act 1971.
The controversial incident took place on December 16, 2008, during a meeting organised in memory of K P Hormis by the Fedbank Hormis Memorial Foundation here, in which he allegedly asked the audience to sing the National Anthem by placing the right hand on the chest on the model of America.
The private complaint against Mr Tharoor was filed by Human Rights Protection Centre State General Secretary Joy Kaitharath, alleging that Mr Tharoor, who was then an MP, after delivering the Hormis Memorial Lecture interrupted the National Anthem to urge the audience to place their palms over the heart as the Americans do, instead of the attention posture.
