This refers to Judicial Intervention in land acquisition by Dr Raja Muzaffar (Daily Excelsior 28.3.2018) . I am happy to know that Judiciary has come to the rescue of farmers affected by Ring Road in Kashmir by passing an interim direction which favours the affected people . National Highway Authority of India (NHAI) as per my information has no issues in paying four times more compensation to affected farmers in J&K as it pays same type of compensation to affected farmers in other states. NHAI has told J&K Govt to take a lead but for making payment of mere 10 percent of its share J&K Government is reluctant to adopt the new Land Acquisition Act. Pertinently the payment given to affected people especially farmers is 90:10 wherein NHAI pays 90 percent of share and J&K Govt pays 10 percent of the total compensation. The State land and Kahchari compensation during acquisition has to go to into village panchayat account , but sources say that this is not happening in the case of land acquisition for Ring Road. Sub Divisional Magistrates (SDMs) were appointed as collectors in many districts through a Government order but Assistant Commissioner Revenue (ACR) is taking a lead during land acquisition for whole district especially in Budgam which is totally illegal. Hope Judiciary takes a strong note of these issues as well during the next hearing of this historical case.
