Srinagar, Dec 21: Jammu and Kashmir High Court today issued a bailable warrant against Commissioner/Secretary Housing and Urban Development Department Satish Nehru for disobeying the court orders.
Nehru was directed by the court earlier to appear in person and file statement of facts about the promotion of petitioner employees in the department who had alleged discrimination against them which has been granted to their counterparts despite being junior to them.
A Single Bench of High Court comprising Justice Ali Mohammad Magray directed the registry to issue a bailable warrant in the amount of Rs. 10,000 for securing his presence.
“Neither the compliance report is filed nor is the respondent present, leaving no option but to secure his presence by coercive method,” the bench said.
The court had earlier directed the respondents (Housing and Urban Development Department) to consider representation of the petitioners to decide their promotion under rules.
But, the respondents “deliberately ignored” the direction and neither considered the case of petitioners nor decided the same, and then petitioners filed the contempt petition against the respondents, seeking framing of rules against them for disobeying court directions.
