HC upholds trial court’s decision on murder

Srinagar, Dec 12: Upholding a trial court’s conviction and life imprisonment of a murder accused, High Court today dismissed an appeal of the convict.
A Division Bench of High Court comprising Justice Virender Singh and Justice Janak Raj Kotwal observed that prosecution evidence was sufficient to prove charges against the appellant.
A Sessions court in Kupwara had in 2010 awarded life imprisonment and fine to murder accused, Mohammad Yousuf Lone for murdering Farooq Tanki of Watal Kadal, Srinagar.
Lone had committed the murder by killing Tanki when the latter and his wife were staying at a friend’s house at Kalaroos in Kupwara in year 1997 after Lone had brought them there.
Subsequently, Tanki wife Rubeena had filed a complaint at the Police Station Kalaroos. Police had arrested Lone who had confessed the crime.
After trials in the Sessions Court in Kupwara, the judge had convicted him of murder for life and theft.
Later, the convict Lone filed an appeal in the High Court which was dismissed by the Division Bench.
“We have carefully scrutinized the judgment and have found that the learned trial court has evaluated the evidence of the approver with reference to and in the backdrop of Law governing the field and relied upon the same,” the Bench said while dismissing the appeal.
