HC upholds discharge of Tehsildar

Rs 9.55 cr Katra stamp duty scam

JAMMU, June 9: In the much publicized Rs 9.55 crore Katra stamp duty scam, High Court has upheld the discharge of Tehsildar Kunal Sharma, the then Tehsildar by the Additional Anticorruption Court Udhampur.
Upholding the order of Anticorruption Court Udhampur, Justice Rajnesh Oswal observed, “as per the record Patwari, Girdawar and Naib Tehsildar have a role to play in preparation, verification and attestation of the revenue extracts”, adding “the Tehsildar concerned has only to countersign and append a note on the copies ‘valid for one month only’. No obligation has been imposed upon the Tehsildar to visit the spot and then to countersign the revenue extract”.
“The application for the issuance of revenue extract was submitted to Naib-Tehsildar-Rattan Singh (Now dead) on 28.12.2010, who forwarded the same to Patwari (Om Parkash) for necessary action. The Patwari (Om Parkash) prepared the extract, which was verified by Girdawar (Hukum Chand). Naib-Tehsildar(Rattan Singh-deceased) was required to satisfy himself with the record and then to attest the four copies of the Fard. There was no responsibility imposed upon the respondent-Kunal Sharma to visit the spot”, High Court said.
“The trial court has considered the issue in detail and this court does not find any illegality or impropriety in the same. All the petitions are found to be without merit and the same are, accordingly, dismissed”, High Court said.
