HC upholds detention order issued by DM

Srinagar, Oct 9: High Court has upheld the detention order of a person issued by District Magistrate Bandipora on the grounds that his actions are against the Government.
Justice Ali Mohammad Magrey dismissed the plea of one Sajad Ahmad Nawoo challenging his second detention. “… this Heabus Corpus Petition fails and is dismissed, as such. The impugned detention order challenged in this petition, accordingly, sustains and is maintained,” reads the judgement.
Justice Magrey observed that the detention survives, even if, one of the grounds taken in support of the petition remains unexplained or proves to be bad in law, therefore, the detention order can be maintained in absence of any explanation on this count by the respondents.
Sajad Ahmad Nawoo of Tangpora Naidkhai Tehsil Hajin District Bandipora has been detained under the orders of District Magistrate Bandipora with a view to preventing him from acting in any manner prejudicial to the maintenance of public order and has been lodged in Central Jail, Kot Bhalwal, Jammu.
State Counsel while opposing the quashing of detention order of Nawoo submitted before the Court that his activities being anti-national and continuously indulged in instigating/provoking the youth as well as general public against the Government, therefore, his further detention was necessary to prevent him from indulging in such acts, which was also approved by the Government and the State Advisory Board constituted u/s 14 of P.S. Act.
It may be mentioned that hundreds of persons have been detained after abrogation of Articles 370, 35A on August 5 to prevent any law and order situation.
