SRINAGAR, Apr 29: Jammu and Kashmir High Court today held the detention slapped on a drug peddler as cogent and reasonable and dismissed his petition seeking quashing his detention.
Naseer Ahmad Pandit of Pulwama was put under detention for prevention of illicit traffic in Narcotic Drugs and Psychotropic Substance Act (NDPS) in the year 2015 by Divisional Commissioner Kashmir when he was caught with 124 bottles of Rancof Syrup.
Challenging the detention order petitioner maintains that Rancof Syrup is not a Psychotropic substance as per the list of psychotropic substances attached to the schedule to NDPS Act as such there is total non-application of mind on part of the detaining authority in passing detention order.
On the other hand respondents submit that the detention order has been passed with a view point to prevent the detenue from indulging in illegal trade of illicit traffic in NDPS after it was satisfied by the detaining authority that the detenue is indulging in illegal trade in an organized manner, which is a great threat for sustaining the conservative values of the society.
It is further contended that petitioner Pandit who was working as daily wager in horticulture department has started dealing in illicit trafficking in NDPS since his childhood which he carried discreetly by creating contacts with likeminded elements in Pulwama area and he was arrested several times into the illicit trade of drugs.
