JAMMU, Sept 5: High Court has stayed the order of the Government whereby three Incharge Executive Engineers namely Ghulam Nabi Ganai, Latif Ahmed Malik and Kuldeep Kumar Mangotra have been temporarily placed as Incharge Superintending Engineers (Civil) Hydraulic Wing.
The order has been passed in a petition filed by Doulat Ram Bhagat and Ved Parkash. Advocate Abhinav Sharma, appearing for the petitioners, submitted that this order has been passed in violation of order passed by the High Court whereby respondents were restrained from filling up the post of Superintending Engineer in Hydraulic of PWD by stop gap/ adhoc/incharge basis/arrangment till next date of hearing.
Advocate Sharma further submitted that contrary to the direction, Commissioner Secretary, PHE issued Govt Order No 240-PW(HYD) of 2015 dated August 21, whereby the private respondents have been temporary placed as Incharge Superintending Engineer (Civil) Hydraulic Wing in their own pay and grade on stop gap basis.
After hearing Advocate Abhinav Sharma in length, Justice Janak Raj Kotwal issued four weeks’ notice to State of J&K through Commissioner/Secretary PHE, Irrigation and Flood Control, J&K PSC through its Secretary and temporary promoted SE and directed them to file response.
In the meanwhile, High Court stayed the impugned order.
