JAMMU, Dec 28: High Court has stayed the posting of Prem Nath as Incharge Chief Engineer CI&D Wing PDC Kashmir.
The order was passed in a petition filed by BK Khajura seeking quashment of Order No. JKSPDC/CJ/36 of 2018 dated 13.12.2018, through the medium of which, Prem Nath under the garb of holding the charge of Chief Geologist, Geological Wing, Power Development Corporation has been illegally placed against the post of Chief Geologist, even when respondent is working as Assistant Executive Engineer on substantive basis in Public Health Engineering and at present posted as Incharge Chief Engineer CI&D, Srinagar in JKSPDC.
After hearing Advocate Abhinav Sharma for the petitioner, Justice Sindhu Sharma observed, “petitioner is aggrieved of Order No. JKSPDOCJ/36 of 2018 dated 13.12.2018 vide which respondent was placed as In charge Chief Engineer CI&D Wing PDC Kashmir in addition lo his own duties”, adding “contention of the petitioner is that respondent is neither qualified nor eligible to hold the post in terms of the Jammu and Kashmir Power Development Department Geology (Gazetted) Service Recruitment Rules, 1979”.
Accordingly, High Court issued notice to the respondents returnable within four weeks. “Subject to objection, and till next date of hearing, operation of impugned order No. JKSPDC/CJ/36 of 2018 dated 13.12.2018 shall stay”, the High Court directed.
