HC stays FIR against Inspector

JAMMU, May 24: High Court has stayed FIR registered against Inspector Traffic Police Naveen Sharma and issued notice to Vigilance Organization Jammu.
Advocate Meenakshi Salathia appearing for the Inspector submitted before Justice Janak Raj Kotwal that FIR No.178/2010 dated 14/10/2010 for commission of offence under Section 408 RPC came to be registered against Neeraj Chandel, son of Om Parkash of Chowk Chabutra at Police Station Pacca Danga and investigation was entrusted upon the petitioner the then Incharge Police Post Chowk Chabutra.
During the course of investigation, name of one Sandeep Anand, son of Om Prakash Anand of Bishnah came up as accused and the petitioner fulfilling his legal obligation presented the Challan No. 08/2011 against the accused persons before the competent court of law for commission of offences under Sections 408/406/201/34 RPC.
“The accused persons are facing trail for the commission of alleged offences arising out of FIR 178/2010 and the prosecution is leading the evidence in the case. Feeling revengeful and vindictive against the petitioner, the accused persons filed a complaint dated 28/12/2011 against the petitioner with the Senior Superintendent of Police, Crime Branch Jammu based on false, frivolous and baseless facts”, the counsel for the petitioner submitted.
The complaint was thoroughly investigated and in terms of the report submitted by Sub-Divisional Police Officer City North Jammu to the Superintendent of Police, City North Jammu dated 27/04/2012, it was established that the complaint against the petitioner was filed by the accused persons only to defame/harass the petitioner. Despite submission of the report the complaint against the petitioner was again verified by the SSP Jammu, who vide communication dated 18/05/2012 to the Deputy Inspector General of Police, Jammu, once again submitted that the complaint against the petitioner was false and baseless and not based on facts.
Notwithstanding the report dated 27/04/2012 and 18/05/2012, the respondent without verifying the veracity of allegations leveled by Sandeep Anand and Neeraj Chandel against the petitioner registered the impugned FIR No. 20/2017 dated 19/05/2017 for commission of offences under Prevention of Corruption Act and Section 342 RPC, which is grave violation of fundamental, legal and statutory rights of the petitioner.
