HC stays execution of detention under PSA

Srinagar, June 21: High Court today stayed the execution of detention order passed under Public Safety Act (PSA) in view of ailment of detenue.
The detenue-Ajaz Ahmad Rah of Khalid Colony Soura, Srinagar was detained under order passed by District Magistrate Srinagar on April 5 for the activities prejudicial to the activities of the security of the state.
His counsel submitted before the court that the order passed in the first week of April has not been executed so far by the authorities and that the petitioner is suffering from HTN, Right sided paralysis (Hemiplegia) certified by SMHS Hospital, Srinagar
Justice M A Chowdhary after issuing notice to the authorities for filing of reply to the contentions raised in the plea against the passing of detention order also stayed the execution of the order of detention in question. Court, however, made it clear that the stay on execution of the detention order shall be till the next date of hearing.
The detention order was passed on the detenu-Rah after the Senior Superintendent of Police, Srinagar has submitted a dossier for issuance of warrant for detention under the provisions of J & K Public Safety Act. The SSP, Srinagar has reported the detenue has come into contact with cadres of ISJK banned outfit who motivated him to work for the outfit as Over Ground Worker ( OGW ) for providing logistic support.
It is being asserted that having radicalized thoughts in short span of time the detenu-Rah became a staunch OGW of your area, besides preach spread militant ideology in the area and motivated youth for joining unlawful activities in the area.
He was earlier arrested in (FIR No. 48/2020 U/S 320, 395 – IPC 7/25, 7/27 IA Act 16, 18, 19, 20, 23, 39 UA (P) Act of P/S Soura, Srinagar. The case stands challaned on 19/12/2020 before the TADA/POTA Court Srinagar.
From acting in any manner prejudicial to the maintenance of security of the state, DM Srinagar said it is necessary to detain the detenue under the Provisions of J & K Public Safety Act and as such directed that the he be detained under PSA and ordered to be lodged at Central Jail, Jammu, Kotbhalwal.
