HC stays DM’s order on cable network

JAMMU, Nov 26: State High Court today stayed the order of District Magistrate Kathua regarding sealing of Cable Television Network and issued notice to respondents to file objections within four weeks .
The stay order was issued by Justice Dhiraj Singh Thakur after hearing  Advocates S K Shukla and Surjeet Singh Andotra for the petitioner.
The counsels have made a distinction between registration required under 11 C and one required under Rule 5. According to them, the registration under Rule 11 C is required only in such a case where the cable operator is operating for the notified area and using digital addressable system in that area, the court observed .
The counsels further prayed  that petitioner is not at all using digital addressable system nor Kathua has been notified by the Central Government in terms of Section 4-A as the notified area which authorizes the Central Government to mandatorily require the cable operator to transmit or retransmit the programme through digital addressable system in any form.
