HC seeks view point from amicus to address issues of Dal

SRINAGAR, May 1: As directed by the court, the Lakes Conservation Management Authority (LCMA) today submitted its suggestions and viewpoints in order to address the issues of Dal Lake and the court asked the amicus to give his views to these suggestions by next date.
The court on last date of hearing of the PIL on preservation and conservation of the Dal lake identified certain specific issues of the lake which include its Cleanliness, Flow of sewage and liquid waste, Solid Waste Management in and around the lake, the responsibility of the Tourism Department qua the development of tourist and recreational sports maintenance and creation of public facilities, Management of the problems concerning houseboats, Stoppage and removal of unauthorized construction and all encroachments in and around the lake area and responsibilities of the Lakes and Waterways Development Authority (LAWDA) as also that of Srinagar Municipal Corporation (SMC) and had directed the LCMA to give its suggestion to address these issues so as to enable the court to pass appropriate orders.
Syed Musaib, Dy. AG in terms of these directions today submitted documents running about 1000 pages, detailing the suggestions/perspectives of the authorities (LCMA) pursuant to the previous order of the court.
The copy of these documents has been furnished to the Amicus Curiae to the PIL and Sr. Counsel Z A Shah in open Court. “He shall give his views on these suggestions put forth by the respondents (LCMA) on or before the next date of hearing”, The Division Bench of Chief Justice N Kotiswar Singh and Justice Moksha Kazmi directed.
Court has also directed the LCMA for payment of Rs. 20,000 be made to Saima Mehboob and Ahra Syed, assisting counsels to the Amicus Curiae. “Accordingly, we direct the authorities to pay Rs. 20,000 to each of the assisting counsels to enable them to effectively assist the learned Amicus Curiae”, reads the order.
While acknowledging the significance of all these issues, the Court deemed it appropriate to prioritize issues of Flow of sewage and liquid waste in the Dal, Solid Waste Management in and around Dal Lake stoppage and removal of unauthorized construction and all encroachments in and around the lake area and responsibilities of the Lakes and Waterways Development Authority (LAWDA) as also that of Srinagar Municipal Corporation (SMC).
