HC seeks status of recovery of Kahcharai land

Srinagar, Nov 21: The High Court has sought information from the Government with regard to recovery of grazing land from the illegal occupation in J&K UT and directed to do needful by or before next date without any fail.
The Division Bench of Chief Justice N Kotiswar Singh and Justice M A Chowdhary directed for compliance of court judgment passed way back in 2016 whereby Government was directed to constitute two authorities each for Jammu and Srinagar for implementation of legislatures viz J&K State Land Revenue Act, J&K State Agrarian Reforms Act and other allied Acts.
“The last compliance report relating to recovery of Kahcharai land was filed in 2018. This Court has desired to get the latest status as regards the recovery of Kahcharai land. Let respondents do the needful, without fail, on or before the next date”, the DB directed.
Court was hearing a contempt petition filed against the authorities at the helm of affairs for not implementing the 2016 judgment.
Court had also directed both the constituted authorities to monitor the implementation of all these legislatures and also evolve mechanism for protection and preservation of the retrieved land.
The authorities were directed to file compliance report after every two months. Only a statement of facts stands filed by the then Tehsildar, Kupwara, informing this Court that steps for retrieving encroached land are going on.
He has also informed that after his joining he had retrieved 16 kanals of Kahcharai land from the encroachers upto ending September, 2018. The statement of facts also mentions that the former Tehsildar, Kupwara had retrieved 120 kanals and 10 marlas of Kahcharai land from March 2018 to ending August 2018.
The authorities are under directions to take full action in terms of the directions of this Court.
In case there is any encroachment of land in pursuance of which action is not taken, liberty is given to the petitioner to inform the official respondents about the same who shall proceed in the matter in accordance with law and the directions made by this Court.
