Srinagar, June 1: High Court today sought response from the authorities to the plea of journalist Shah Fahad challenging the detention order passed against him under Public Act.
Fahad submits before the court that the allegations levelled in terms of grounds of detention against him are baseless, unfounded, vague and without any substance. He adds that there is no iota of truth in the allegation against him of creating law and order problem in the society and has never acted in any manner or behaved in any way by his writings or deeds or by using social media which would constitute any offence in terms of law or which could promote violence or lawlessness in the society at large.
The detenue-Fahad was arrested on 04.02.2022 by the police of police station Pulwama and booked him in an FIR No 19/2022 under Section 13 of ULA ( P ) , Section 124A and Section 505 IPC consequently an application of bail was filed before the court of competent jurisdiction at Pulwama.
He was granted bail by the trial court and was not released and shifted to the police station Imam Sahib Shopian where on the same set of offences he added, another FIR bearing No.06 / 2021 under offences 153 and 505 I.P.C was registered against him. Thereafter he was shifted to police station Safakadal , Srinagar where one more FIR has been registered against him.
He challenged the order of detention issued by the District Magistrate Srinagar on 11-03-2022 by virtue of which he was taken into preventive custody. The court of Justice Puneet Gupta while hearing his plea against his order of detention directed the authorities to file their counter affidavit within four weeks.
Peerzada Fahad Shah of Dawood Colony Anchar Soura, Srinagar has been detained for commission of offences of instigation for which the Senior Superintendent of Police, Srinagar on 11-01-2022 submitted a dossier for issuance of warrant for detention under the provisions of J & K Public Safety Act.
The dossier submitted by the District Police, Srinagar delineates his journalism journey citing a series of instances leading to disturbance in public order and in many cases inciting violence. A number of incidents have been cited wherein it is submitted that he was indulged in inciting violence thereby leading to disturbance in public order.
