HC seeks response on contempt proceedings filed by army against CEO, DC Baramulla

SRINAGAR, Apr 17: High Court has sought response to the contempt proceedings against Chief Executive Officer (CEO) Gulmarg and Deputy Commissioner Baramulla filed by Army for not allowing them to lift construction material for the necessary repairs and renovation of High Altitude Warfare School (HAWS) in Gulmarg tourist resort.
The division bench of Chief Justice Pankaj Mithal and Justice Rajnesh Oswal directed CEO GDA and Deputy Commissioner Baramulla to respond to the contentions raised by the petitioner-Army in contempt petition within two weeks. Counsel appearing for GDA denied the contentions as raised in the contempt plea and sought time to file the response.
Counsel appearing for the Army submitted before the bench that despite court orders the authorities are not permitting the Army to take the construction material on the site as such are violating the court directions as already passed in this regard. High Court has already allowed the Army to make necessary repairs and renovations to the structures of High Altitude Warfare School in Gulmarg tourist resort.
The application was moved by the Army through its counsel T A Shamsi (ASGI) for affecting the repairs and renovations of structures in question subject to a video recording of the existing structure of the school.
By the medium of the instant contempt petition court has been called upon to proceed against the contemnors-CEO GDA and DC Baramulla for having violated the orders of the Court under the Contempt of Courts Act.
Court while granting the relief to the extent of renovations and repairs of the school had made it clear that in case the applicant (Army) deviate from the information which has been furnished to BOCA, no equity shall flow in favour of the applicant and the applicant would have to abide by any orders which may be necessitated.
