HC seeks report on spurious drugs

SRINAGAR, Apr 30: The State High Court today issued notice to the Government asking it to file the status report about the fake drugs that were supplied to the Government hospitals in Jammu and Kashmir by tomorrow.
The division bench of the High Court comprising Justice Mansoor Ahmad Mir and Justice Ali Mohammad Magray today issued notices to Chief Secretary, Commissioner Secretary Health and Medical Education, Drug Controller, Chairman Central Purchasing Committee, Controller Drug and Food Organization and Director Health Services Kashmir and asked them to file status report of the recent drug scam and action taken against the culprits.
The Court has also directed the Crime Branch to file status report about the FIR filed against the companies that supplied and manufactured the fake and spurious drugs. The High Court also issued notice to then Health Minister Sham Lal Sharma during whose tenure these fake drugs were supplied to Government hospitals across the State.
The court directions came in response to a PIL filed by Dr Nisarul Hassan and Shafat Rasool seeking directions from the High Court to constitute a committee of experts to look into the scam.
The PIL also sought directions from the court seeking reasons from the Government for not testing the supplied drugs in a testing laboratory. It also sought directions for setting up of a testing laboratory, loss to the State exchequer and fixation of liability on the persons involved in the scam and impartial probe.
Last week a special TADA court in Srinagar issued non-bailable arrest warrant against 15 suppliers and manufacturers of a spurious drug Maxamizine-625 to Government hospitals in Jammu and Kashmir.
It may be mentioned here that Excelsior broke the spurious drug scam early this month leading to registering of cases against suppliers and manufacturers of Maxamizine-625 drug that was supplied to hospitals across Kashmir valley. The antibiotic tested negative for amoxicillin while the company had claimed that it contains 500 miligramme of amoxicillin.
The drug, Maximizane 625 milligram, along with several other drugs were chosen in random sampling for laboratory testing by the Drug Controller Kashmir during winter. The drugs were sent to the laboratory for testing and the anti-biotic tested negative as the laboratory report revealed that it contains “NIL” Amoxicillin. The drug contained Zero milligrams of Amoxicillin tri-hydrate while the company claims that it contains 500 milligrams of Amoxicillin tri-hydrate + 125 milligrams clavulanic acid.
