Srinagar, Aug 17: The State High Court today directed the Government to produce the report of the enquiry committee, set up to look into fake certificate scam in Indian System of Medicine Department allegedly issued by Director of the Department, within seven days or Commissioner Secretary of H&ME shall appear before the court on next date of hearing.
Advocate General, Jehanghir Ganai, sought further one week’s time for producing the report of the committee which the Division Bench of Chief Justice N Paul Vasanthakumar and Justice Hasnain Masoodi granted with the observation, “Court cannot remain silent if fraud has been committed” and directed the listing of the PIL on Aug 25 for further consideration.
Earlier, State had sought week’s time for producing the report of the enquiry committee and today again time has been sought. On last date of hearing, court had directed production of vigilance record pertaining to the scam and the same was produced today before the court.
Government has ordered enquiry (vide order NO. 277-HME of 2015 dated 22.7.2015) about the issuance of fake Dawasaaz (Pharmacist) certificates allegedly by the Director ISM Dr Abdul Kabir to the hundreds of persons. Government ordered an exhaustive enquiry into the scam so that detailed reply be filed before the High Court in a PIL wherein it is alleged that Director ISM has issued Dawasaaz (Pharmacist) certificates to the hundreds of persons as none of them have ever been admitted to any college or institute for undergoing such training or ever having attended any classes or practical or appearing in any test or examination.
As the court is seized of the matter about the issue of fake certificates and Government till date didn’t come up with a clear stand before the court and today when the case was taken up for further proceedings Advocate General sought further time for submitting the report of the committee. Government has constituted a three member committee and had asked the said committee to file its enquiry report with one week.
Government has appointed Madan Lal (Joint Director Planning) as chairman of the enquiry committee while as Tahir Mustafa Malik (Under Secretary) H&ME and Pooja Rasgotra (Under Secretary) H&ME as members of the enquiry committee.
Petitioner is seeking Dawasaaz certificates issued by the Director and those which are lying in his record should be declared null and void further Director Vigilance be directed to register FIR against the Director ISM under Section 5(2) of the PC Act and till such time he(Director) be removed from the said post so that the record be protected.
