Srinagar, May 22: The High Court has sought records of Cabinet decision regarding appointment of Principal Government Medical College, Srinagar.
Hearing a writ petition filed by Dr Javed Chowdry challenging the appointment of recently appointed Principal of GMC Srinagar on the ground that it was illegal and against his fundamental rights.
Under the Cabinet decision which has taken place on April 28 in which Dr Samia Rashid has been appointed as GMC Principal, petitioner challenged her appointment on the ground that he being the senior most member of the medical faculty has not been considered for the post.
Court of Justice Tashi Rabstan issued notice to the official which have been accepted by the State Counsel on their behalf for filing of reply to the petition of Dr Chowdry within two weeks. Court also issued notice to Dr Sami Rashi (Principal of GMC) and directed for keeping the records of cabinet decision available before the court on next date.
Dr Chowdry also submitted that he was only eligible candidate for the post of Principal from the year 2013 but was never promoted to the post in 2014 and instead extension was given to the then Principal of the college at the cost of his service career.
Referring the previous appointment of Principal of the college, he further alleged that the said person was also junior to him and high level establishment cum selection committee has recommended his case and sanction was also granted to his appointment and only approval was sought from the Cabinet as per rules and laws, but he was dropped and his junior most person (Dr Samia) in the penal who was never recommended by the committee.
