HC restrains PSC from issuing result of screening test

JAMMU, Nov 13: High Court today restrained the Public Service Commission from issuing result of screening test for the post of Assistant Engineer (Electrical, Civil and Mechanical) till next date of hearing.
The direction was passed in a petition filed by Satyarth Ashok Gupta and others seeking quashing of Advertisement Notification No.15-PSC (DR-P) of 2013 dated August 12, 2013 for Assistant Engineer Electrical, Notification No.18-PSC (DR-P) of 2013 dated October 15, 2013 for Assistant Engineer (Civil) and Notification No.19-PSC (DR-P) of 2013 dated October 15, 2013 for Assistant Engineer Mechanical whereby the respondents provided the procedure for short listing and selection by taking into consideration academic qualification at graduate level vide Rules 40 and 50 of J&K Public Service Commission Rules, 1980.
The petitioners termed these Rules as arbitrary, discriminatory and in violation of Article 14 and 16 of the Constitution of India. They also prayed before the court for passing necessary directions to the respondents for issuance of fresh notifications by providing uniform written test for the purpose of short-listing and or final selection. They said that marks obtained in written test shall be counted for the purpose of final selection along with higher qualifications/interview marks.
After hearing the counsel for the petitioners Advocate Pawan K Kundal, Justice Tashi Rabstan issued notices to the respondents and in the meantime restrained them from issuing result of screening test in pursuance to the Advertisement Notifications challenged by the petitioners.
