HC rejects intervention in ETT College scam investigations

SRINAGAR, Oct 2: Jammu and Kashmir High Court rejected applications of hundreds of Elementary  Teachers Training (ETT) Colleges seeking intervention in the multi-crore ETT scam whose investigation conducted by Crime Branch of Jammu and Kashmir Police is being monitored by the court.
The Division Bench of Justice MH Attar and Justice Ali Mohammad Magrey while dismissing various applications of ETT Colleges said the court cannot hear the applicants as its earnest effort is the investigation be conducted fairly and in accordance with law. “For the aforesaid reasons, these application held to be meritless and are, accordingly dismissed”, court said.
“In view of huge public interest involved, the court is continuously monitoring the investigation and whenever required, necessary directions, in accordance with law, are being issued for conducting the investigation fairly and expeditiously”, court observed.
The ETT colleges had submitted applications before the court seeking intervention so that they could have put their view point before the court at the time when court is only monitoring the investigations.
Court is monitoring the investigation of FIR No. 36 registered in 2013 by Crime Branch at Jammu for allegations of mass irregularities and commission and omission in running EET Institutes in Jammu Province and FIR No.26 of 2013 registered by Crime Branch in Srinagar.
The investigating agency (CB) is conducting investigation both at Jammu and in Srinagar in accordance with the provisions of Criminal Procedure Code and Challan has also been filed in the competent court of law at Jammu in this regard by CB on last month.
Court also said that it is not to decide anything which would adversely affect the legal interests of the applicants (colleges). During the arguments of the case counsel appearing some of the colleges submitted and relied the judgment of Supreme Court wherein some schools were ordered to be impleaded as party in that PIL but the court turned down the submission of the counsel by observing the present case is different here.
Various officials including former Chairman and Secretary of Board of School Education recently have been found involved in the mass irregularities of ETT Institutions and subsequently have been arrested by the Crime Branch.
Crime Branch has already informed the court that the ETT Colleges is a big money scandal and almost all concerned people are involved in the loot as the candidates are lured and huge amount, ranging from Rs.45000 to Rs. 80000 is received from each student and this scandal is run by mafia in league with top brass of the Board of School Education Department.
