SRINAGAR, Sept 1: High Court today refused to grant bail to accused involved in murder case and asked him to approach the ‘High Powered Committee’ as constituted by the Government for his release on parole.
Through the medium of application, the applicants-accused involved in the commission of offences punishable under section 302, 307, 34, 102-B, 326, 324 and 506 of the erstwhile RPC were seeking bail.
Their counsel submitted before the court that in view of sharp spike in the number of COVID-19 pandemic cases all over and in different jails in particular including the Central Jail Srinagar where the accused are lodged, their life is under threat therefore they deserve to be admitted bail.
Government in opposition to the submission of petitioner-accused counsel submitted before the court that the applicants are facing trial in a case involving heinous offences as such do not deserve the concession of bail more so there is every likelihood on halting the investigation in case they are enlarged on bail.
Justice Ali Mohammad Magrey after hearing the rival contentions of both the parties dismissed the bail application by recording that there is no merit in the instant application. “The applicant, however, shall be at liberty to approach the ‘High Powered Committee’ as constituted by the Government of J&K UT in compliance of the directions passed by the Supreme Court in suo moto proceedings, with the application for seeking their release on parole or interim bail”, court said.
Court also added that if any application made by the applicants before the HPC same shall be considered and decided by the Committee in accordance with the directions passed by the Supreme Court expeditiously.
