HC quashes selection of 900 wireless operators

SRINAGAR, May 15:  Jammu and Kashmir High Court today quashed selection list of at-least 900 wireless operators in Jammu and Kashmir Police Telecommunications.
Justice Hasnain Massodi today directed respondents to reframe the list for appointment in order of merit against 1126 posts admittedly proposed to be filled up on finalization of selection process initiated vide an advertisement notice 9 of March 2007. The court directed the respondents to reframe the list as per J&K Reservation Act, 2004 and J&K Reservation Rules, 2005.
The court directed that the exercise shall be completed within four weeks from the date the respondents receive the copy of the judgment.
“Selection and appointment of such of the private respondents, who find place in the reframed select list and having regard to their place in the merit list and the number of vacancies to be filled up, make grade for their appointment, shall remain intact and undisturbed,” the court said.
While quashing the list, the bench observed that the advertisement notice was not tailored in accordance with rules as it neither mentioned number of posts to be filled up with district wise breakup nor did it inform the candidates of the selection at district level.
“Had recruitment been intended to be made district wise, respondents would have maintained District wise Roaster in compliance of Rule 5 of reservation Rules 2005,” the court said while pointing out that mode and method of selection was in gross violation of J&K Reservation Act 2004 and J&K Reservation Rules 2005.
The court also turned down the argument by respondents that it would be too harsh to set-aside Select List as the appointees have already worked for last at-least three years, the bench said it must not influence the Court to legitimize an unfair and arbitrary selection that smells favoritism.
