HC quashes PSA of OGW

JAMMU, Dec 25: State High Court has quashed the detention order under PSA of alleged Over Ground Worker (OGW) of the Hizbul Mujahideen and LeT outfit.
The District Magistrate Doda on February 15, 2011 directed detention under PSA of Ghulam Nabi, son of Bilal Ahmed Lone, who was allegedly over ground worker of banned LeT/HM outfit. The detention order was passed on the basis of dossier submitted by SSP Doda and in view of the prevailing situation in the Doda district.
After hearing Advocate D S Chouhan appearing for the petitioner whereas Senior AAG Gagan Basotra for the State, Justice JP Singh observed, “neither in police dossier nor in the grounds of detention it is indicated that detenue was likely to be released from police custody and rightly so, in that, being accused of heinous offences, there would have been no likelihood of his release from custody on bail”.
In the circumstances, the detenue could not therefore be ordered to be detained in preventive custody on self-assumed supposition that too without any reasonable doubt, the High Court said.
With these observations, High Court quashed the detention order passed by DM Doda and directed to release the detenue from preventive custody.
