HC permits Army to raise transit camp at Sonamarg

Srinagar, July 4: High Court has permitted the Army to raise construction of Transit Camp at Sonamarg as has been proposed before Building Operations Controlling Authority of Sonamarg.
As there is blanket ban on any kind of construction in the area by the court, the Army approached court with a writ petition mentioning therein that the existing infrastructure at Sonamarg is inadequate to house the staff in transits. It had proposed to reconstruct and improve the existing infrastructure by raising the necessary permanent housing structure.
Tahir Shamsi appearing for Union of India pointed out before the court that despite passage of six months, BOCA has not moved at all in the matter. It is further pointed out that the petitioner-Army has only two months left now before weather condition and the construction thereafter would be rendered impossible in the area.
“Keeping in view of the imperative need of the armed forces as well as the security of their personnel, it is evident that the matter brooks no further delay”, Division Bench of Chief Justice Gita Mittal and Justice Rashid Ali Dar said and permitted to raise the Transit Camp.
Court said Army is permitted to raise construction of the Transit Camp at Sonamarg as has been proposed in the submission made to BOCA on 12th December 2018.
Court, however, granted liberty to BOCA and the Chief Town Planner, Kashmir to inspect the ongoing constructions and to point out any rectification(s) which are required to be undertaken by the Army.
The construction, court added, in terms of the present order shall be subject to further orders of the Court.
