HC issues notice to Govt, Bank

Srinagar, July 29: High Court today issued notice to the Government of J&K and J&K Bank and sought reply to the plea challenging the notification for the post of Banking Associates omitting the reservation of 6 percent for ex-servicemen.
Twenty one ex-servicemen of Indian Navy have approached the Court for not reserving 6% quota for them as is prescribed in Reservation Rules of 2004 seeking quashing of notification dated July 2 issued by the Chairman J&K Bank advertising therein 1500 posts of Banking Associates.
Justice Ali Mohammad Magrey after hearing the counsel for petitioners advocate Arif Sikander said, prima-facie the respondent-Bank has mutatis and mutandis applied reservation rules of J&K UT to the recruitment of process qua Ex-Servicemen and also there is not protection of the pay scale by mentioning revised which amounts to depriving the petitioners to the extent of 6% reservation.
“Notice in the main petition as well as in connected applications returnable within a period of one week. Objections by or before next date of hearing with a copy advance to other side. List on August 7”, Justice Magrey directed.
For protection of the petitioner, court also directed the Bank to open online registration of applications for the petitioners for four days starting from July 30 so as to enable them to submit the application forms. However, court added, the submitting of application forms would be on their (petitioners) own risk and responsibility and the same shall be subject to the further orders of this court.
Advocate Sikander informed the court that the benefit of reservation rules notified in the year 2004 has been applied to the J&K UT by the bank for this recruitment process but the petitioners are deprived because of the revised pay scale as mentioned which is more than prescribed pay scale.
Referring the advertising for filing of various vacancies in the J&K, he informed the court that selection authorities like Service Selection Board recently issued advertising of posts of Accountant Assistant in Rural Development & Panchayat Raj mentioned the pre-revised pay scale qua entitlement of ex-servicemen for these posts.
Court has sought reply from Principal Secretary to GAD and Commissioner/Secretary to Social Welfare Department for processing the amendment in the pay scale qua revision of pay scale within 8 days.
