HC issues notice in petition challenging PCB order

JAMMU, June 9: In a petition filed by M/s Hotel Novelty at Ragunath Bazar challenging the notification issued by Chairman J&K State Pollution Control Board by virtue of which commercial operation of the hotel was suspended for not complying with the requirement of effluent/sewage standards by having STP of requisite capacity, High Court today issued notices to Commissioner-cum-Secretary Tourism Department, Chairman J&K State Pollution Control Board, CEO ERA Jammu, Director Tourism and Regional Director PCB returnable within four weeks.
Advocate Pranav Kohli appearing for the petitioner submitted that only ground contained in the impugned order was that the hotels having capacity of 20 or more rooms are required to meet the effluent / sewage standards prescribed under Environment Protection Act by having STP of required capacity in place in the hotel.
“The standards laid down in the impugned order do not pertain to the petitioner as the petitioner’s hotel is having only 11 rooms”, he further submitted.
After hearing Advocate Pranav Kohli in length, Justice Bansi Lal Bhat ordered that subject to the objections from other side and till next date of hearing before the bench, operation of impugned order dated May 10, 2014 shall remain stayed.
