JAMMU, Aug 17: The High Court of J&K and Ladakh at Jammu has granted pre-arrest bail to six persons after the same was rejected by the Sessions Court.
The case was registered under Sections 307/329 (3)191 (2)/191(3)/190/115(2)/352/351(2)/351(3) of BNSS of 2023 and 4/25 Arms Act arising out of FIR number 98/2024 at Police Station Bishnah and the accused persons got interim bail from Session Judge Jammu which afterwards rejected the same. The complainant in said FIR No 98/ 2024 was Advocate Amit Puriya of Bishnah.
After rejection, the accused moved the High Court and the Advocate Sanjeev Padha, Counsel for the accused pleaded that presence of the accused in the custody was not imperative for the progress of investigation and the Judge Mohd Yousuf Wani stated that the Court was in agreement with the law relied upon by the Counsel for the petitioners to the effect that there is no bar in approaching the High Court under the provision of Section 482 BNSS after the first application of the same nature was rejected by the Session Court.
The High Court granted bail in anticipation of arrest to Dwarka Nath Sharma, Surinder Sharma, Anil Sharma and Naresh Sharma-all sons of Devi Dutt Sharma and Vasu Sharma son of Dwarka Nath and Abhishek Sharma son of Surinder Sharma, all residents of village Chak Lala in Bishnah.
The High Court allowed the bail application and SDPO North, Jammu/SHO Police Station, Bishnah, Jammu were directed that they shall in the event of arrest of the petitioners in the case of FIR number 98/2024 registered at Police Station Bishnah let them off, subject to the petitioners furnish bail and personal bonds.
