HC go ahead for SIs’ appointments

Srinagar, Apr 13: In a major relief to 477 Sub-Inspectors selected in Police Department, the High Court has modified its stay order and gave nod for their appointment with a rider that it shall be subject to the outcome of writ petition.
Court in January this year had put on hold the selection process of about 477 posts of Sub Inspectors and had directed the authorities not to issue their appointment orders.
After perusal of the order, court said, while issuing notice to the authorities, it had observed that further action in pursuance of selection process shall remain subject to outcome of writ petition and that appointment orders shall not be issued till response is filed by the authorities and members of selection committee is brought on record.
Justice Ali Mohammad Magrey said there shall be no impediment for the authorities to proceed ahead with the selection and appointments.
“Meanwhile, with a view to clarify the position, the order dated 11th of January, 2019 passed by this court, is modified by providing that subject to objections from the other side and till the next date of hearing before the Bench, it is directed that the selection/ appointment in question shall remain subject to outcome of the writ petition”, Justice Magrey directed.
Court, however, in order to save the case of petitioners (non-selectees) while modifying its previous order, directed that equal number of posts shall be reserved for the petitioners in both the writ petitions.
Various non-selected candidates approached the court by way of two writ petitions challenging the selection of 477 Sub Inspectors in Police Department submitting that the selection for the posts is full of discrepancies and irregularities.
Court has already called for whole record pertaining to the selection for the perusal of the court and record pertaining to the action initated, if any, on receipt of the complaints from aggrieved candidates for probe into irregularities and discrepancies.
It is contended before the court that the failure on the part of the officials to constitute a board in terms of SRO 202 of which reference was made also in advertisement notice for making selection for SIs, vitiates the whole process and the participation in the selection process would not make any difference.
Petitioners through their Counsel have also submitted before the court that the higher officials have facilitated mass copying in one of the centers where 620 candidates have appeared out of whom 499 were shortlisted for interview and wherein 185 candidates have been selected and 39 have figured in the waiting list.
Another ground which the non-selectees have taken with regard to bad selection by the higher official is that no CCTV technology has been done to video-graph various stages of recruitment for maintenance of backup of the record and tracking of activities at various recruitment centers as was necessary in terms of advertisement notice itself.
It is mentioned here that the advertisement for 482 posts of Sub Inspectors (Executive Cadre) and 176 posts in Armed Police Cadre was issued in December 2016 and selection for these posts was issued on December 2018.
Petitioners in the present case are seeking quashing of selection of 477 candidates reflected in the selection list as also the selection of candidates who appeared in the examination center situated at Channi, Jammu wherein as per the petitioners mass copying has taken place.
They had also prayed that appropriate action be taken against the selection committee members and erring officers, who allowed to “commit fraud” and who did not preserve CCTV footage of the center at Channi, Jammu.
