Srinagar, Sept 12: High Court has directed the Social Welfare Department for necessary steps and action on non-functioning of Day Care Centre (DCC) in Srinagar.
The petitioner was seeking directions for the restoration and the maintenance of the Day Care Centre for senior citizens established at Chanapora way back in 2019 which he said, was inaugurated by the then Chief Justice of High Court
Division Bench of Chief Justice Pankaj Mithal and Justice Puneet Gupta while closing the petition said that the petitioner has submitted a representation and his grievance can be considered by the Principal Secretary to the Government Social Welfare Department.
Court granted liberty to him to file a fresh representation in continuation with his early representation before the Principal Secretary SWD within a period of two weeks raising all his grievances therein.
“In the event, any such, representation is filed by him within a period of two weeks’… shall call for a report and after due verification of the necessary facts, pass suitable speaking order in accordance with law most expeditiously preferably within a period of two months from the date of filing the representation,” DB directed.
The petitioner submitted that the Day Care Centre has stopped functioning and the authorities are not taking care to restore it. He has said that the Act mandates that the State Government may establish and maintain old age homes in a phased manner at least one in each district on the basis of the provision.
The counsel representing the petitioner submitted that the respondents are obliged under law to establish old age homes in every district and at least the Day Care Centre for the senior citizens established earlier is made operational and in this connection a representation was submitted to the Principal Secretary to the Government Social Welfare Department.
The SWD counsel informed the court that appropriate steps have already been taken and the petitioner has filed this writ petition without making a proper study of the matter as to whether the Day Care Centre for senior citizens is operational or not.
