JAMMU, Aug 27: High Court has directed the State to go ahead with the installation of Sewage Treatment Plan at Agling in Leh.
The direction was passed by Justice Tashi Rabstan while disposing of a petition seeking quashment of Consent Order No. 1638 dated 14.03.2016 issued by J&K Pollution Control Board, through its Member Secretary vide Serial No.SPCB/T/C/40/5540-43 dated 14.03.2016 in favour of Executive Engineer, Public Health Engineering Division, Leh for establishment of Sewage Treatment Plant at Agling, Leh on the ground that process of construction of STP was in violation of Air (Prevention and Control of Pollution) Act, 1981, Water (Prevention and Control of Pollution) Act, 1974 and Environment (Protection) Act, 1986.
After hearing both the sides, Justice Tashi Rabstan directed respondent to go ahead with the installation of Sewage Treatment Plant at Agling, Leh. “However, the same shall be strictly in terms of the conditions as contained in the impugned Consent Order and the mandatory standards as are prescribed for establishment of such STPs”, Justice Rabstan added.
The respondent was further directed to construct and design the STP in such a way that it would not emit any foul smell nor would pollute the water stream which is adjacent to the proposed STP, rather it must be good for keeping the environment clear and also good for public at large.
“While establishing the STP, respondent would also strictly follow and implement the observations made by the National Green Tribunal and the Sewerage Department shall not operate the STP until the J&K Pollution Control Board issues its consent to operate fresh”, High Court said.
