HC directs Govt to implement orders for regularization of daily wagers in judiciary

Srinagar, Jan 10: High Court directed the Government to implement the directions for regularization of daily wagers in judiciary without any fail and submit compliance report.
State counsel in compliance to court orders produced a communication addressed by the Deputy Registrar (Adm) to the Assistant Legal Remembrancer LJ&PA and sought time to comply the directions passed from time to time.
“Time is granted till Feb 5, to comply the directions passed by this court from time to time without fail”, High Court directed.
It may be mentioned here that the Government has already formulated the policy for addressing long pending issues of daily wagers and casual labourers who have served more than 7 years in various Government departments.
With regard to regularization of daily wagers, High Court is seeking implementation of observations made by Supreme Court in which State Government has been held responsible for creating such situation.
In view of Supreme Court observations, High Court had directed the Finance Department to take a call at the earliest without any further delay. People working as daily wagers in the judiciary are for more than 10 years.
Supreme Court in its judgment has said the State Government has created situation of recruiting persons on daily wage basis on large scale and has blamed the Government for the ‘unfortunate situation’ which has resulted in a large number of persons being recruited on a daily wage basis.
Earlier, High Court had granted final opportunity to Government to come up with the solution of daily wagers in light of Supreme Court observations and warned if the issue is not worked out then court will issue orders.
Proposals for creation of various posts have already been sent to LJ&PA Department by the Registrar General of High Court with a request that the proposals which are pending consideration to see the light of the day at the earliest.
About the lawyers chamber in new District Court complex at Moominabad, Court has been informed that no steps have been taken by the Government to construct the chambers for practicing lawyers.
Court directed the Bar President to submit a representation to the Chief Justice, indicating the number of advocates who need chambers so that a plan can be prepared based on requirement.
On receipt of the representation, Court directed that registry shall after due consent of Chief Justice forward the request to the Law Department, with a copy marked to Chief Engineer  PWD and Chief Architect for drawing a plan for construction of additional building to accommodate the advocates.
