HC directs GAD Secy to appear in person

JAMMU, Apr 26: In a contempt petition filed by Hoshiar Chand and another for non-compliance to the judgment in 2009 KAS batch case, High Court today directed Commissioner/ Secretary to Government, General Administration Depart-ment to appear in person on next date of hearing.
Vide judgment passed on April 1, 2016 in 2009 KAS batch case, the High Court had directed the respondents to accord consideration to the case of the petitioner for his selection and appointment against a post having remained unfilled or rendered vacant under ALC category due to non-joining of any candidate. The High Court had also fixed six weeks period for ensure compliance to the directive.
After hearing Advocate Aparajita Jamwal for the petitioners, Justice Janak Raj Kotwal observed, “neither representation on behalf of the respondents nor compliance report/statement of facts have been filed”, adding “the counsel for the petitioners states that judgment of this court has not been complied with till date”.
“As neither respondents have filed the compliance report/statement of facts nor there is any representation on their behalf and the judgment of this court passed in April, 2016 is stated not to have been implemented”, Justice Kotwal said and directed Administrative Secretary General Adminis-tration Department to remain present in person on the next date to assist the court.
