SRINAGAR, Nov 18: High Court directed the Railway authorities to effect the transfer of its employees strictly as per the provisions of transfer and posting contained the Rules and Guidelines.
The Division Bench of Justice Sanjeev Kumar and V C Koul dismissed the petition seeking review of the judgment passed in February 18 whereby bench had that the transfer policy of the employees of Railway as without jurisdiction and issued by incompetent authority and directed for reconsidering the transfer of railway employees within four weeks.
The DB has made it made clear that in terms of the judgement dated 18-02-2021, bench has left it open to the Railway authorities to effect the transfers of its employees including the aggrieved employees strictly as per the provisions of transfer and posting contained in the Railway Establishment Rules, Circulars and Guidelines, if any, issued by the Railway Board on the subject from time to time.
“The Court has only quashed the rotational transfer policy, which was issued by the Divisional Manager, Railways, Firozpur, without jurisdiction. Be that as it may, the applicants have failed to demonstrate any error of fact or law apparent on the face of record, which may impel us to revisit and review our judgement dated 18-02-2021. This petition is, therefore, found to be without merit and is, accordingly dismissed”, DB concluded.
The DB further added that it has elaborately considered the issue of jurisdiction of the Divisional Manager, Railways, Firozpur, to frame the transfer policy inconsistent with the transfer policy framed by the competent authority – Railway Board.
