Srinagar, Feb 18: High Court has sought suggestions from amicus as also the response from the Government to analyze the functioning of erstwhile Monitoring Committee, Scientific Committee, Vigilance Committee and present Committee of Experts (CoEs) over the preservation and protection of Dal Lake.
The Division Bench of Justice Ali Mohammad Magrey and Justice V C Koul has sought such suggestions after the amicus to the PIL Z A Shah (Senior Advocate) submitted before the bench that the Court needs to analyze the functioning of the Monitoring /Scientific and Vigilance Committees constituted prior to the constitution of Expert Committee as also the reports of the Expert Committee for effective improvement in preservation, conservation and protection of the Dal Lake.
“We have taken note of the submissions of ZA Shah, Amicus Curiae and on consideration, deem it proper to seek suggestions of Amicus Curiae in writing as also the response of the Government of Jammu and Kashmir”, the DB said.
In this exercise Amicus Curiae, Court said, shall be assisted by Salih Pirzada, Advocate and Advocate Syed Musaib. For preparation of the analysis, Court directed the Registry to provide all the requisitioned material to the Amicus Curiae, comprising of reports of the earlier Monitoring, Scientific Committee, Court orders and reports of the Legal Expert Committee.
“The requisitioned material shall be provided to ZA Shah, Amicus Curiae within one week. Thereafter Shah, Amicus Curiae shall submit the details within two weeks with copy in advance to the Government, who shall submit the response within one week thereafter”, court directed.
The committee so constituted was requested to undertake a comprehensive review of the steps taken so far by the Monitoring Committee as well as the Vigilance Committee with regard to all matters relating to the Dal Lake.
When the matter was taken up for consideration, Amicus Curiae invited the attention of the court to the object of entertaining the petition in public interest for preserving and protecting the famous Dal lake.
He submitted that the object to some extent stands achieved by the endeavour and efforts of the court as also the stake holders including LAWDA. He further submits that for effective implementation of the schemes, projects, laws on the subject, the court prior to appointment of CoEs had at one point of time, directed the Government for constitution of Monitoring Committee, headed by the Chief Secretary and Scientific Committee, which committees on their constitution had shown effective results.
The Court in terms of order passed in 2018 on detailed consideration of the matter decided to constitute Committee of Experts comprising of some retired officers and earlier constituted Monitoring, Scientific and Vigilance Committees were put an end with the formation of CoEs.
