JAMMU, May 28: In a petition filed by one Ashok Kumar challenging the tentative seniority list of Patwaris, High Court today granted four weeks last opportunity to the official respondents for filing reply failing which Divisional Commissioner Jammu will have to appear in person on the next date of hearing.
According to the petition, the petitioner was appointed as Patwari vide Govt Order dated February 18, 1999 and his seniority has not been fixed in terms of his merit in the Patwar Training Course. He submitted that the seniority has been fixed on pick and choose basis and all the private respondents, who have been shown senior to the petitioner, have obtained less marks than the petitioner.
The official respondents without going into the record and without considering the objection of the petitioner have finalized the seniority list, the petition said.
After hearing Advocate Ajay Abrol for the petitioner whereas Senior Advocate RS Thakur with Advocate Pankaj Jamwal for the private respondents, Justice Tashi Rabstan observed, “despite lapse of three years, reply has not been filed by the official respondents showing their casual approach”, adding “today also neither reply nor counsel for the official respondents is present”.
