JAMMU, Aug 30: In a petition filed by Forum of Investors in Online Bike Boat Scheme who were duped of the financial investment made by them in response to an offer made by the M/s Garvit Innovative Promoters Limited (Bike Boat) Company Ghaziabad, High Court of Jammu and Kashmir has directed the CBI to register FIR.
After hearing Advocate Anuj Dewan Raina, Justice Rahul Bharti observed, “this court is of the opinion that an alleged act of crime, and which too is of nature of the financial fraud, needs an investigation and cannot suffer delay for even getting registered at the instance of the aggrieved person(s)”.
Accordingly, High Court directed that in the event of Suresh Kumar Bhat, son of Lambodar Bhat of Vasant Vihar, Trikuta Nagar, Jammu as being the representative of the Forum of Investors in online Bike Boat Scheme approaches the Central Bureau of Investigation and Anti-Corruption Bureau Ghaziabad with a complaint then the compliant be diarized as FIR by the Central Bureau of Investigation and Anti-Corruption Bureau so as to undertake and proceed ahead with the investigation in the matter as is being done in cases of identical nature.
The nature of the criminal fraud allegedly suffered by the individuals forming the petitioner at the hands of the respondent is M/s Garvit Innovative Promoters Limited (Bike Boat) Company had come forward with an advertisement in the public domain offering a scheme inviting the public to invest an amount of Rs 62,100 as price of one bike with the respondent which in turn would return to the given investor on monthly basis of an amount of Rs 5,175 for a period of one year plus crediting an amount of Rs 4,590 to the investor as a rental income of the bike so purchased.
As against one time investment of Rs 62,100 a prospective investor was to get a monthly return of Rs 9,765 for 12 months in recurring plus the bike. This advertisement had laid many gullible persons to become investors and found their investment getting lost at the hands of the respondent and its promoters.
