HC directs Ansari to file response to inquiry report

SRINAGAR, Dec 28: The State High Court directed the Minister for Youth, Sports and Services Imran Raza Ansari to file his response to the enquiry report of complaint filed against him by the Enforce-ment Officer LAWDA alleging his interference with the demolition drive and using abusive language against the officer.
Court directed this after the enquiry officer appointed by the court to probe the allegation leveled against the Minister in to the complaint filed by the Enforcement Officer of LAWDA.
Court perused the report filed by the enquiry officer Syed Javed Ahmad (Retired District and Sessions Judge) which was in a sealed cover and after perusal of the report it has been handed over to Registrar Judicial in open court and he was directed to keep it in a sealed cover with advance copy to counsel representing the Minister for response. “He shall, however, provide copy of the same to learned counsel for Imran Ansari, who will be at liberty to file his response”, Division Bench of Justice MH Attar and Justice Ali Mohammad Magrey directed.
The complaint against Ansari was filed by Deputy Superintendent of Police (Enforcement Officer LAWDA) alleging that the Minister has called him on phone when he was on demolition drive with other staff in and around the peripheries of lake. It was alleged in the complaint that the Minister has used abusive and un- parliamentary language against Enforcement Officer while calling him on phone, which the Minister vehemently denied in his reply.
Filing his reply to the allegation contained in the complaint, the Minister denied those allegations leveled against him and thereafter Court in order to reach to proper conclusion and to recommend any action in the complaint said the same is required to be enquired as such in its previous order appointed Syed Javed Ahmad, retired District and Sessions Judge as enquiry officer into the matter. Court also asked the enquiry officer to provide opportunity of hearing to both the parties and start the enquiry proceedings with one week from the date copy of order is received by him.
Meantime, Court has been apprised about the deliberation taken in 6th meeting of monitoring committee convened under the chairmanship of Chief Secretary of the State and amicus to the PIL Z A Shah (Senior Advocate) invited the attention of the court to the issues raised and considered in the aforesaid meeting.
“It is our firm belief that the monitoring committee will continue to take steps to preserve the water bodies, more particularly, the Dal lake, which, as is said, is the crown in the jewel of Kashmir, otherwise known as heaven on earth”, Justice Attar and Justice Magrey said after submissions made by the amicus.
Court Commissioners have also filed their report in which various issues were mentioned. Court directed the registry to serve the report copy to monitoring committee and directed the said committee to consider the report and expedite the decisions, wherever required to be taken, especially court said, about the acquisition of land.
State Counsel submitted that the Government has initiated steps for integrated development of Hazratbal Shrine which is to be done under National Mission on Pilgrimage Rejuvenation and Spiritual Drive (PRASAD) scheme.
He submitted that if orders are not issued by the court for undertaking these activities, then money released for the said purpose will lapse. “In view of the aforesaid fact situation, we allow the concerned authority to proceed ahead with the proposal of Integrated Development of Shrine”, DB directed in this regard.
Court meantime made it clear that interim directions wherever passed by the Court shall remain in force till next date before the bench. Competent authority (PCB) has also been directed to proceed on the issue of STP of Hotel Grand Palace which earlier was not meeting with the requirements.
SHO Ram Munshi Bagh has filed the compliance report with regard to investigation in FIR No. 95/2016 filed against the BJP MLC Ajat Shatru Singh for raising constructions in prohibited area, in which SHO states that the investigation is complete and challan in the case will be filed in the court of competent jurisdiction in near future.
