Jammu, Mar 6: In a writ petition filed by Sunil Mahajan challenging the allotment of hall No 209 South Block Bahu Plaza in favour of Sajjad Ahmed Bhat, brother of Union Health Minister Ghulam Nabi Azad, State High Court today directed the Secretary Housing and Urban Development to appear in person along with State Government’s explanation for non compliance of court directions.
After hearing Advocate S S Ahmed appearing for the petitioner whereas AAG H A Siddqui for the State and Advocate I H Bhat for the private respondent, Justice J P Singh observed, “disposing of a batch of writ petitions vide judgment dated June 1, 2009 directions were issued requiring the State Government to examine the issue as to the impropriety or illegality of the allotments of shops/halls at Bahu Plaza complex for passing appropriate orders/ directions as warranted under law after affording reasonable opportunity of hearing to those who may be prejudicially affected by the order, which the Government may consider passing in this behalf”.
“The judgment of the Court has attained finality. However, despite taking numerous opportunities to report compliance of the directions the needful has not been done”, Justice J P Singh said.
Taking serious note of non-compliance of the Court directions, High Court said, “the State Government is required to show cause as to why the concerned functionaries of the State Government, who are responsible for the non-compliance of the Court directions, be not proceeded against”.
With these observations, Justice J P Singh issued notice to Commissioner Secretary, Housing and Urban Development Department to appear along with State Government explanation for non-compliance of court directions.
