HC directive on contractual lecturers

JAMMU, Jan 23: In a petition filed by the contractual lecturers, High Court has directed the State to consider the petitioners if it proposes to make appointments on contractual basis during the next academic session. Notice was also issued to the respondents returnable within two weeks.
The petitioners were engaged as 10+2 lecturers on contractual basis in Government Higher Secondary Schools, Chowki Ramnagar and Marta and under Section 5 of the J&K Civil Service (Special Provision) Act 2010 they fulfill all the conditions and are entitled to seek the benefit of regularization of their services.
However, respondents issued a circular dated May 5, 2010 contrary to the provision of the Act and by virtue of which all the Chief Education Officers (CEOs) of Jammu province were directed not to allow the candidates engaged on academic basis/ contractual basis in Higher Secondary Schools after April 2010.
“Now again the same direction has been issued to all the CEOs not to allow 10+2 lecturers engaged on contract/academic arrangement basis after the completion of 2012 and 2013 session”, the petitioners submitted, adding “the respondents are also threatening the petitioners that they would be replaced by regularly appointed candidates against the mandate of J&K Civil Service (Special Provision) Act 2010”.
After hearing Advocate Dheeraj Choudhary appearing for the petitioners, the High Court issued notice to the respondents returnable within two weeks and ordered that in the event respondents propose to make appointments on contractual basis during the next academic session, petitioners should also be considered having regard to the fact that they are already serving as contractual lecturers.
