HC directive on Khyber constructions

SRINAGAR, July 18: Jammu and Kashmir High Court directed law officer Pollution Control Board (PCB) to Hotel Khyber Resort in Ski resort of Gulmarg following allegations of illegal construction by the owners.
“Mohammad Maqbool Shah, law officer PCB, who is present in the court has acceded to our request to personally visit the post known as Hotel Himalaya Khyber resort and furnish report with regard to the allegation made in the application” said a division bench comprising Chief Justice MM Kumar and Justice Hasnain Masoodi
Counsel for the applicant also submitted that it is a willful and deliberate violation of orders passed by this court in Public Interest regarding protection and preservation of famous ski resort.
Court also issued notice to GDA which was accepted by their counsel, advocate Mohsin Qadri, and he has been directed to file complete status report regarding allegations made in application.
In another application where in issue of dumping of waste on Forest land in Gulmarg on large scale which pollutes the environment of area and emits bad odour has been raised.
Court issued notice to the concerned and directed the executive officer Municipal Committee Tangmarg to ensure that no waste is dumped on the said land till further orders and sought comprehensive report from Forest Department about the damages caused due to dumping the waste in the forest area.
