HC denies bail to alleged stone-pelter

SRINAGAR, July 31: High Court has rejected the bail application of Ghulam Jeelan Gatoo, an alleged stone pelter.
According to the police case, 02.02.2018, Police Station Shopian received an information from reasonable sources that in view of a call given by the activists of the Hurriyat Conference (JKLF Group), the accused Ghulam Jeelani Gatoo, son of Ab. Aziz Gatoo, Faisal Amin Mir, son of Mohd Amin Mir and Arsalaan Bashir, son of Bashir Ahmad of Shopian assembled after Friday prayers at Jamia Masjid, Shopian and pelted stones upon the security personnel with the intention to kill the police/security forces besides causing damage to the Government property.
While rejecting bail application, Justice MK Hanjura observed, “Single Bench of the High Court does not have the jurisdiction to decide and determine an application for grant of bail wherein the provisions of Unlawful Activities are invoked and the Special Court has passed an order in the application”.
“Such an order can be appealed against before a Division Bench  as a corollary to which this application is dismissed with the liberty to the applicant to work out remedy before the proper forum”, High Court said.
