JAMMU, Sept 20: High Court today allowed Registrar General to make temporary promotions of Munsiffs.
The permission was granted by Justice Ali Mohd Magrey after going through the application filed by Registrar General seeking modification of orders passed on September 5, 2012 and August 22, 2013 on the ground that about 20 courts are without Presiding Officers (Sub-Judges) as a result of which the litigants are suffering. It was also contended that the Munsiffs, who have been selected/appointed in the recent past, cannot be posted unless the promotions are made amongst the existing Munsiffs.
After hearing Senior Advocates D C Raina, VR Wazir with Advocates FA Natnoo and Veenu Gupta for the petitioners whereas Advocate Aditya Gupta for the High Court and Advocate SS Ahmed for the private respondents, Justice Ali Mohd Magrey observed, “in the given circumstances, the application filed by Registrar General High Court is allowed and the order dated September 5, 2012 read with order dated August 22, 2013 is modified to the extent that Registrar General is allowed to make temporary promotions of Munsiffs subject to final outcome of the final seniority list to be drawn within the period granted by this Court”.
“The promotions shall be made on stop-gap arrangements which shall not confer any right on promotees and shall be subject to outcome of the final decision of the petition”, Justice Magrey said.
