Govt withdraws shady Jammu land transfer order

SRINAGAR, Aug 8: The Revenue Department withdrew the shady land transfer order of over 312 kanals of State land to a private party in Jammu after Deputy Commissioner Jammu withdrew his recommendations of the allotment.
The Commissioner Secretary Revenue Department, Vinod Koul, issued an order (No. Rev/S/195/2014 dated 05-08-2014) to withdraw the allotment of State land measuring 312 kanals and 5 marlas situated in village Bain Bajal, Tehsil and district Jammu that was transferred on lease for a period of 40 years in favour of the Jammu and Kashmir Housing Corporation Limited.
The shady land deal was exposed by Excelsior last month forcing the Government to first keep the order in abeyance and later withdraw it.
The order reads: “… in view of the proposal earlier made by Deputy Commissioner Jammu vide his letter No. DCJ/SQ/CHCL/Bain Bajal/2014-15/558 dated 29-05-2014 having been withdrawn by him vide his fresh communication No. DCJ/SQ/CHCL/Bain Bajal/2014-15/1025-28 dated 18-07-2014, the Government order No. Rev/S/142 of 2014 dated 19-06-2014 issued under endorsement No. Rev/S/106/2014 dated 19-06-2014 shall and shall always be deemed to have been rescinded/withdrawn in abinitio.”
The Revenue Department withdrew the allotment order after Deputy Commissioner Jammu, A K Sahu, withdrew his proposal regarding the allotment. The DC while withdrawing his proposal regarding the allotment of the land says that he was of the impression that the Jammu and Kashmir Housing Corporation Limited is a Government owned body.
“…the recommendation was made considering the Corporation as the Government owned body and with the impression that it is being controlled by the Housing Department and matter shall be placed before the cabinet after taking opinion of the Housing Department”, reads  DC’s Jammu letter (No. DCJ/SQ/CHCL/Bain Bajal/2014-15/1025-28 dated 18-07-2014).
The Revenue Department’s order withdrawing of land transfer reads: “Whereas, pending consideration on the fresh request made by Deputy Commissioner Jammu regarding re-visiting his earlier proposal and on the basis of instructions received from Chief Secretary vide his No. PS/CS/21/2014 dated 14-07-2014 the Government order No. Rev/S/142 of 2014 dated 19-06-2014 was kept in abeyance vide Government order No. Rev/S/167 of 2014 dated 17-07-2014 which was, however, superseded by Government order No. 786-GAD of 2014 dated 18-07-2014 by virtue of which the Government No. 781-GAD of 2014 dated 17-07-2014 was ordered to have overriding effect…”.
Earlier, the Government under the instructions from Chief Minister, Omar Abdullah through Chief Secretary, Mohammad Iqbal Khanday had kept the land transfer order in abeyance till further orders.
