JAMMU, July 31: Government has terminated the services of Suresh Kumar Rekhi, Deputy General Manager, Jammu and Kashmir Projects Construction Corporation (JKPCC) Leh Unit ab-initio.
As per the order issued by Managing Director, JKPCC Vikas Kundal, Suresh Kumar Rekhi was appointed in JKPCC as Assistant Manager (Civil) in the year 1993 and at the time of appointment he had furnished Permanent Resident Certificate (PRC) issued by the concerned Revenue authorities.
However, FIR No.19/2014 was lodged in the Vigilance Organization (now Anti-Corruption Bureau) against Rekhi on account of fake and forged PRC and after investigation Revenue authorities cancelled the PRC of Rekhi and other family members ab-initio.
In the month of February this year, Public Works Department forwarded a communication from the General Administration Department to JKPCC with the direction to take necessary action against Rekhi. Later, JKPCC sought guidance from R&B Department, which vide communication dated July 7, 2021 conveyed the authorization to terminate the services of Suresh Kumar Rekhi on the grounds that any appointment based on a fake certificate, which forms the basic eligibility, is non-est in the eyes of the law and no right flows from anything that is a nullity or a non-est right from the very inception.
“Since the incumbent has obtained the service on the basis of fake PRC, the requirement of Article 311 is not applicable to him as expressly mentioned in the communication of GAD”, the R&B Department told JKPCC.
Now, in the light of the authorization of competent authority conveyed by R&B Department the Managing Director of JKPCC Vikas Kundal has terminated the services of Suresh Kumar Rekhi, DGM JKPCC Ltd Unit Leh ab-initio.
