Govt relaxes its order of restricting transfer, postings of employees

Transfers to be effected till Jan 31

JAMMU, Jan 6: Citing the ‘interest of administration’, the Government of J&K Union Territory today relaxed its earlier order fixing specific period of year for effecting transfers and postings of the employees.
Relaxing its earlier direction that the calendar fixed in the Transfer Policy of 2010 shall be mandatorily followed by all the departments while ordering the transfers, the fresh Government order was issued today by Commissioner Secretary GAD, Manoj Kumar Dwivedi, thus fueling the speculation that major reshuffle is on the cards.
“In view of the need to effect the transfers/postings of Government employees in the interest of administration, necessitated either on account of urgency involved or their stay beyond the prescribed period, there shall be a relaxation of Government order No. 948-JK(GAD) of 2020, dated 15-10-2020,” read the order No.15-JK(GAD) of 2021, dated 06-01-2021.
During the period of relaxation, further says the fresh order, the competent Authority as per Transaction of Business Rules of the Union Territory of Jammu and Kashmir, shall effect transfers till 31st January, 2021, subsequent whereof, the restriction imposed vide Government order ibid shall resume.
The Government also ordered that such transfers/postings shall be affected in a manner that these are restricted to 15 percent, ensuring further that the employees having the maximum tenure are considered for transfers in the first instance and the others thereafter.
The Government has ordered relaxation for effecting transfers and postings within two months of its earlier direction fixing specific period during the year for this exercise in an attempt to put an end to the practice of ordering frequent rotation of the officials.
As desired by the Lieutenant Governor, the Government vide order number 948-JK(GAD) of 2020, dated 15-10-2020, had issued directions that the calendar fixed in the Transfer Policy of 2010 should be mandatorily followed by all the departments while ordering the transfers.
Pertinent to mention here that Transfer Policy for Government employees notified vide Government Order No.861-GAD of 2010 dated July 28, 2010, provides among other things, the calendar for transfers to be ordered in the financial year.
The Para-B of the Transfer Policy read: “Transfers shall ordinarily be ordered in the first month of the financial year-April excluding the transfer of the teaching staff and transfers to Ladakh. The transfers of teaching staff shall be considered at the close of the academic session and must be avoided during the academic session”.
“The notification of the calendar has been made with the intent of ensuring that the transfers are limited to a particular period of the financial year so that minimum dislocations occur during the financial year which would ensure better outcomes in the implementation of various Government schemes and policies”, said the earlier order of GAD.
Besides, the Administrative Secretaries were also directed to dissuade their concerned Heads of the Departments from ordering any transfer/rotation proposal on lower levels so that period notified in the Transfer Policy of 2010 is strictly adhered to. Also making it clear that any transfer, which is required to be ordered on the administrative grounds beyond the notified calendar, shall be effected only with the approval of the Lieutenant Governor, the departments were required to justify the same with substantive grounds.
However, within two months, the Government today relaxed its own order for transferring employees till January 31, 2021, thus indicating that major reshuffle at various administrative levels is on the cards.
