Srinagar, May 1: In a first, Jammu and Kashmir administration today dismissed a Government teacher, Idrees Jan, under recently invoked Article 311 of the Constitution in the interest of the security of the State.
The teacher who was posted at Government Middle School, Kralpora, Kupwara was dismissed from the services in the interest of State. He is the first Government employee to be dismissed from services after last month’s Government order of formation of task force to recommend the dismissal of the employees in the interest of the security of the State.
An official said that 2 FIRs are registered against him in Police Station Kralpora for allegedly inciting people to violence.
Idrees said that he had two FIRs registered against him and was arrested by police twice. In 2010 an FIR was registered against him in Police Station Kralpora in Kupwara for inciting violence (stone pelting) and was arrested for by police but was later released.
In 2016, another FIR was registered against him in the same Police Station for inciting people to violence. He was later booked under Public Safety Act (PSA) for four months and was lodged at Kotbhalwal Jail Jammu.
Idrees said that he was today called by Naib Tehsildar Dardpora in district Kupwara where he was handed over the dismissal order in presence of SHO Kralpora.
A Government Order No 400 JK(GAD) of 2021, Dated 30.04.2021. issued here said: “Whereas the Lieutenant Governor is satisfied after considering the facts and circumstances of the case and on the basis of the information available that the activities of Idrees Jan, Teacher, Government Middle School, Kralpora, Kupwara are such as to warrant his dismissal from service”.
“Lieutenant Governor is satisfied under sub-clause (c) of the proviso to clause (2) of Article 311 of the Constitution of India that in the interest of the security of the State, it is not expedient to hold an enquiry in the case of Idrees Jan, Teacher, Government Middle School, Kupwara,” it said.
“Accordingly, the Government hereby dismisses Idrees Jan, Teacher, Government Middle School, Kralpora, Kupwara from service, with immediate effect”, the order read.
Recently Lieutenant Governor Manoj Sinha constituted a Special Task Force (STF) to “scrutinise cases of employees suspected of activities requiring action under Article 311 (2) (c)”.
