*New criteria applies to all posts of Edu Deptt

JAMMU, Jan 29: To harmonize the service conditions of all the Government employees, the State Government today modified Jammu and Kashmir Special Recruitment Rules, 2015, which provide for appointments on contractual basis, and issued new set of directions to all the departments and agencies for compliance in letter and spirit.
By way of modifications, even the appointments in the Police, Prisons, Fire and Emergency Services Departments, all the Public Sector Undertakings of Jammu and Kashmir and by the Ladakh Autonomous Hill Development Council have been brought under the purview of such rules.
The previous PDP-BJP Coalition Government in the month of April last year had announced new Recruitment Policy whereby appointments against Gazetted and Non-Gazetted vacancies were proposed to be made on contractual basis. Thereafter, the Government Vide SRO 202 dated June 30, 2015 notified Jammu and Kashmir Special Recruitment Rules, 2015.
In Rule 3, it was specifically mentioned that J&K Special Recruitment Rules, 2015 would apply to all the non-gazetted posts borne on the establishment of any department or service of the Government and such gazetted posts, as may be notified by the Government from time to time.
However, following concerns from certain quarters, the General Administration Department vide Order No.1364 dated October 14, 2015 constituted a committee headed by Commissioner/ Secretary to Government, Finance Department to examine the issue of harmonizing the service conditions of all the Government employees with respect to SRO-202 of 2015.
Now, on the basis of the report of the committee, the Government has modified Rule 3 of the Jammu and Kashmir Special Recruitment Rules.
In the modified Rule 3, no powers have been conferred upon the Government to notify from time to time the gazetted posts for recruitment under J&K Special Recruitment Rules. However, it has been clarified that all the non-gazetted posts and notified gazetted posts of the Higher Education and School Education Departments advertized after June 30, 2015 shall be governed by SRO-202 of 2015.
Moreover, it has been mentioned that SRO shall apply to all the posts for which selection is made by the J&K Services Selection Board, Departmental Recruitment Boards or District/ Divisional/ State level Selection Committees relating to the selection in Government departments. Till now, the Departmental Recruitment Boards are following their own Selection Procedure and in future the recruitments by these Boards would be governed by J&K Special Recruitment Rules, 2015.
Moreover, the posts borne on the establishment of any department of the Government, the Police, Prisons, Fire and Emergency Services Departments and the Ladakh Autonomous Hill Development Councils of Leh and Kargil have been brought under the purview of Special Recruitment Rules.
The modification in Rule 3 would also help in checking backdoor appointments in the Public Sector Undertakings/Corporations of Jammu and Kashmir as it has categorically been mentioned that the Managing Directors of the State-owned Corporations shall place proposals, in sync with these Rules, before their respective Board of Directors for approval so that the appointments, if any, to be made in the PSUs, are in tune with the SRO-202 of 2015.
“There shall be no deviation from Jammu and Kashmir Special Recruitment Rules, 2015 issued under SRO-202 of 2015”, reads the Circular issued by General Administration Department.
As per J&K Special Recruitment Rules, 2015, all the departments shall refer the existing vacancies and also the vacancies that would accrue during the year to the concerned selection agencies within a period of one month from the date of issuance of these Rules indicating there in the district wise breakup of available vacancies in each cadre-State, Divisional and District.
About the mode of selection, the Rules state: The selection agency shall invite applications for recruitment under these Rules in respect of district, division or State cadre posts. After assessing the merit of the candidates in a fair and transparent manner, the selection agency shall prepare a select list which shall not exceed the number of vacancies so advertised and furnish the same to the appointing authority within a period of three months from the date of reference of the vacancies.
The selection agency shall also prepare a waiting list up to 20% of the total number of selected candidates and forward the same to the concerned appointing authority, which shall issue appointment orders strictly in accordance with the select list furnished by the selection agency within a period of 10 days positively.
As far as nature of appointment is concerned, the Rules state: A person appointed under these Rules shall be initially on probation for a period of five years and after completion of five years his service shall be declared as permanent subject to passing of such tests, or successfully undergoing such training, as provided under Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956 or as prescribed under the relevant recruitment rules governing the post/service to which he has been appointed.
Moreover, the appointee shall have to necessarily work for a period of five years on the post against which he has been appointed and such appointee shall not be eligible for transfer for whatsoever reason during the temporary service of five years. During the period of first five years, the appointee shall be entitled to the minimum scale of pay along with grade pay applicable to the post against which he is appointed.
The persons appointed under these Rules shall be entitled to annual increments, Dearness Allowance, House Rent Allowance and City Compensatory Allowance after successful completion of five years service on consolidated salary.
