Govt appoints Div Comm as Inquiry Officer

JAMMU, Oct 20: After being reprimanded by the State High Court, General Administration Department today issued order appointing Divisional Commissioner Jammu, Shantmanu as Inquiry Officer to enquire into encroachment of Government land at village Chatta Sunjwan in Jammu district. Interestingly, the order was issued a day before the case is listed before the High Court.
According to the order issued by Secretary GAD, the Government vide Order No.5-GAD of 2008 dated January 1, 2008 had appointed Sudhanshu Pandey, the then Divisional Commissioner Jammu as Inquiry officer to enquire into the matter regarding encroachment of Government land at village Chatta Sunjwan.
“The Inquiry Officer has not completed the enquiry within the stipulated time and now in view of the directions of the High Court in case titled S K Bhalla Versus State of J&K and in supersession of order of 2008, Divisional Commissioner Jammu, Shantmanu is appointed as Inquiry Officer to conduct enquiry into the matter”, the order said. Mr Shantmanu has been directed to submit report within a period of one month.
He will enquire as to whether the land has been transferred in accordance with rules and regulation and with the approval of the competent authority and identify the officials responsible for transfer of any land in favour of SRK Associates in contravention of rules and procedures in vogue or without the approval of the competent authority.
Mr Shantmanu has further been asked to identify the officials responsible for non-consolidation of three patches of land measuring 40 kanals falling under Khasra Nos. 1452, 1445 and 1447 of village Chatta Sunjwan. He will also identify the officials responsible for mutation of 20 kanals and 12 marlas of State land under Khasra No.1442 in favour of Ram Kumar, one of the partners of SRK Associates in contravention of rules and identify the officials responsible for including State land under the layout plan of residential colony of SRK Associates.
It is pertinent to mention here that in its last order the State High Court had directed the Secretary GAD to get the inquiry conducted through the present Divisional Commissioner Jammu or appear in person.
